Courts at the Forefront of Europe’s Value Conflicts

In recent years, Europe’s most contentious value debates have increasingly migrated from the political sphere to the judicial arena. Questions related to gender identity, gender theory, family law, same-sex marriage, media regulation, and freedom of expression are no longer debated primarily through democratic legislation but are progressively shaped through strategic litigation and judicial interpretation at the level of the Court of Justice of the European Union (CJEU).
