Are constitutional courts indispensable constituents of stable democracies? For decades, the dominant view in the legal scholarship argued that constitutional courts should be established after a democratic transformation process in order to protect the democratic order. In the meantime, however, it became obvious that judges should decide cases which required special competences and expertise they don’t possess. In his guest lecture, Paul Yowell (University of Oxford) will investigate where courts face the limits of judicial review.
